1. Contract Formation

By accessing or using the Roliggi website located at https://b8r8mh-3f.myshopify.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the site. These Terms constitute a legally binding agreement between you and Cory Anthony Mello, the individual operator of Roliggi.

2. Governing Law and Venue

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of California. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in California, and you hereby consent to the personal jurisdiction and venue therein.

3. Binding Individual Arbitration Clause

Any dispute or claim relating in any way to your use of the site will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by a single arbitrator under the American Arbitration Association's Consumer Arbitration Rules in California. You have the right to opt-out of this arbitration clause by sending a written notice to support@roliiggifauhen.com within 30 days of accepting these Terms.

4. Class Action Waiver

You and Roliggi agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. Notwithstanding the arbitration clause, nothing in these Terms shall waive any consumer's right to seek public injunctive relief under California law (per McGill v. Citibank, 2 Cal. 5th 945 (2017)).

5. Limitation of Liability

To the fullest extent permitted by law, Roliggi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the site; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein. In no event shall Roliggi's aggregate liability exceed the amount paid by you to Roliggi in the twelve (12) months preceding the claim.

6. Intellectual Property

All content on this site, including but not limited to text, graphics, logos, images, and software, is the property of Roliggi or its content suppliers and is protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of Roliggi. You may not use our trademarks or trade dress in connection with any product or service without our express written consent.

7. User Obligations

By using this site, you agree not to engage in fraudulent activities, scrape or data mine, or resell products without authorization. You must not use the site in any way that causes, or may cause, damage to the site or impairment of the availability or accessibility of the site.

8. Disclaimer of Warranties

The site and all information, content, materials, products, and other services included on or otherwise made available to you through the site are provided by Roliggi on an "AS IS" and "AS AVAILABLE" basis, unless otherwise specified in writing. To the full extent permissible by law, Roliggi disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. This disclaimer does not affect any implied warranties that cannot be excluded under the Magnuson-Moss Warranty Act.

9. Dispute Resolution

Before initiating any arbitration or court proceeding, you must first provide Roliggi with a written notice of dispute via email at support@roliiggifauhen.com, outlining the nature of your claim and the relief sought. We will attempt to resolve the dispute informally within 30 days. If the dispute is not resolved within this period, either party may commence arbitration.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

11. Modifications of the Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of the site following the posting of changes constitutes your acceptance of such changes.

12. Termination

We may terminate or suspend your account and bar access to the site immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
